Article 1 - Scope These general conditions of sale (hereinafter referred to as the "General Conditions") apply without restriction or reservation to all sales concluded between the company Deco55.com (Franck Mashayekhi) who is registered office is 30 rue de Rivoli, 75004, Paris, France and registered in Paris on 04/19/2001 registration number 438 087 140 00036

Deco55.com reserves the right to modify at any time without prior notice to the Customer its general conditions of sale. The modified general conditions of sale are opposable to the Customer from the date and throughout the duration of their online availability for products ordered after their online availability. Each purchase on the Site is subject to all the clauses of the general conditions of sale applicable on the date of placing the order. The Customer can only validate his order after having read these general conditions and having accepted them by checking the box dedicated for this purpose. Deco55.com considers that by validating his order, and checking the box provided for this purpose, the Customer has duly taken note of the general conditions of sale and accepts them without reservation.


The conditions applicable and enforceable against the Customer are those in force at the time of the effective validation by the Customer of his order recorded on the Site. By validating these general conditions of sale when ordering, the Customer declares to have the legal capacity allowing the conclusion of a contract within the meaning of articles 1123 and following of the Civil Code and certifies being a major natural person or trader acting for his needs personal. Article 2 - Purpose The purpose of these conditions is to define the online sales regime for interior and exterior furniture and interior decoration products and the rights and obligations arising therefrom. These general conditions of sale are therefore intended to govern: • The organization of legal relations between Deco55.com and the Client. • The terms of sale between Deco55.com and the Customer (order, delivery, etc.).   Article 3 - Order procedure and terms  3.1 - Customer identification To place an order, the Customer must log on to the Site. The Site is accessible 24/7, subject to incidents affecting the level of services. When placing their first order, the Customer must create a customer account via the "CREATE YOUR ACCOUNT" section and fill in the mandatory information on the form dedicated to this purpose. The Customer expressly undertakes not to use false information or information from third parties. Registration on the Deco55.com Site is effective as soon as the Customer clicks on the "VALIDATE" button. For subsequent orders, the Customer can access his account by entering his username and password. The Customer is fully responsible for his username and password and undertakes to ensure its confidentiality.   3.2 - Placing the order  The Customer must follow the different steps specified on the Site. Any order placed will be confirmed by sending a confirmation email by Deco55.com to the email address indicated by the Customer containing the summary of the order, place of delivery, estimated date of shipment and mode of payment. This information will also be available on the Site in the "MY ACCOUNT" section. If this confirmation email is not received, the Customer must check his spam or other anti-spam software. Prior to the final validation of his order, the Customer has the possibility of making modifications when he finds that an error has appeared in the data entry.  The Customer can only validate his order after having read these general conditions and having accepted them by checking the box dedicated for this purpose. Any order validated by the Customer is only considered effective by Deco55.com after confirmation of payment. The data communicated by the Customer and recorded by Deco55.com during the registration of the order constitute proof of the transactions between the Customer and Deco55.com The information related to the order is subject to computerized data processing for which the manager is Deco55.com, in accordance with the provisions of article 16 of these general conditions of sale.  3.3 - Cancellation  The order is firm for the Customer upon validation of his order, subject to the implementation of article 12 "Right of withdrawal". However, exceptionally, Deco55.com offers the customer the possibility of canceling their order within forty-eight (48) hours after validation. This option can only be carried out on the entire order, so it cannot be partial and can only be accepted if and only if no goods have yet left Deco55.com warehouses The cancellation request is made online, in the "My account / cancellation" section. Being a supra-legal faculty, Deco55.com remains the sole judge of whether or not this cancellation request is accepted. The reimbursement of the order will be made within a maximum of fourteen (14) days,  


Article 4 - Personalization of products


 Deco55.com offers the Customer the possibility of personalizing certain products that he wishes to order on the Site.


The customizable products on the Site relate to all products manufactured or upholstered specifically to the customer's order, these are all sofas, armchairs, chairs, beds or furniture.


In the event of an order for products whose manufacture is made to measure, the Customer may not request the cancellation of his order in accordance with article L 120–20–1 of the Consumer Code which rules out the possibility for the Customer to exercise your right to cancellation


Article 5 - Price


The prices indicated on the Site are expressed in euros, and are understood to include all taxes (VAT included) including VAT at the rate of common law in force and eco-participation (s) applicable where applicable on the day of the order.


Deco55.com reserves the right to modify them at any time, before the final validation of the order, in particular in the event of an increase in charges, the VAT rate, and in the event of a manifest error.


The products are invoiced at the rate in force on the Site at the time of the final validation of the order by the Customer.

The prices and promotional offers indicated on the Site are valid in all European countries Product prices do not include delivery and installation costs. These costs are calculated and added to the total amount of the order after validation of the basket.


 The Customer is informed of the amount of the costs before the final validation of his order.


 Regarding the amount of delivery and assembly costs, they are displayed on the Site and indicated in chapter 9 – Delivery below.


 Deco55.com reserves the right to modify its prices at any time, without notice, it being understood that the price displayed during the order by the Customer will not be subject to any modification



Article 6 - Payment conditions


6.1 - Payment methods


The products presented on the Site are payable at the time of the order, at one time. Therefore, no discount or late payment penalty is applicable. The sums paid in advance are neither deposits nor deposits.


The "promo codes" are reserved for the Website. They can only be used once per customer and per order, and are not cumulative.

6.2 - Fight against fraud

6.3 - Payment incident


Deco55.com will not be required to proceed with the delivery of the products ordered by the Customer if the latter does not pay him the full price under the conditions indicated above.


When the order is debited, in the event of incomplete, irregular or non-existent payment for any reason whatsoever or in the event of any payment incident, Deco55.com reserves the right to suspend or cancel the delivery of orders in Classes.


In the event of non-payment whatever the reason, an amicable fixed compensation of fifteen euros (15 €) will be required by Deco55.com in addition to the amount of the invoice, increased by the debit costs invoiced by the banking establishment of Deco55. com in the event that the amicable recovery would have remained unsuccessful within ten (10) days from the date of dispatch of the first letter of request for recovery, whether this letter is sent by registered letter or by simple letter. The recovery will be done by litigation. The costs of litigation that would be billed by the collection agency intervening for Deco55.com directly to the Customer are independent of the amicable lump sum indemnity.


 In the event of default of payment after a formal notice remains without effect, Deco55.com retains until full payment a right of full property on the products ordered and may exercise an action for claim before the competent judge.



Article 7 - Availability of products



The product offers presented on the Site are valid while stocks last.


Prior to any act of purchase, the Customer is kept informed of the availability of products.


The Customer acknowledges and already accepts that Deco55.com will do everything in its power to process and honor all the orders it has confirmed.  


 Insofar as processing times are necessary between the registration of an order and its payment by the Customer, the products may become unavailable during this period. In the event that, after confirmation of the order by Deco55.com, products become totally or partially unavailable, Deco55.com will inform the Customer by email of this unavailability in accordance with article L 121–20–3 of the Code consumption.


In this context, the Customer has the possibility:


 if desired, to be delivered by Deco55.com of a product of equivalent quality and price. • or to obtain a refund for their order within fourteen (14) days of payment for the product.


 Article 8 – Billing


 The invoice sent to the Customer includes the information entered by the latter in his customer account. The buyer has the possibility of modifying this data on the occasion of any new order placed on the site.



Article 9 – Delivery


 9.1 - Delivery terms The delivery of the products can be carried out in all the Europe + England, Switzerland, Norway zone (for the latter the customs prices or supplement of transport costs are chargeable to the customer)


 Products are delivered to the address indicated by the Customer when ordering.


When placing an order, the delivery method is specified to the Customer.


Deco55.com distinguishes the delivery methods according to the products ordered. The order can therefore be delivered in several packages and on different dates, which the Customer accepts. Each date is indicated to the Customer when he places his order.


 9.1.1 - Pre order and special order


The customer has the possibility of not ordering an item not in stock on the Deco55.com site or in pre-order by paying a deposit of 5 to 20% of the total amount without the delivery costs, as such the customer must accept that this special order cannot be canceled without charge, the charges are the amount of the deposit 


 9.1.2 - Delivery to the address of your choice by carrier Delivery will be made by Deco55.com Products can be delivered anywhere in Europe + England, Switzerland, Norway



Delivery under standard conditions is made for a fee depending on the size and weight of the item and the country of delivery.


These costs are indicated before final confirmation of the order.  The delivered products will be accompanied by a delivery slip.


The Deco55.com delivery service contacts the Customer in order to fix a delivery date within the deadlines indicated during the order and mentioned on the order summary.


 In the absence of the Customer on the day of delivery, the Customer must contact Deco55.com or the carrier at the latest the day before the appointment in order to agree on a new appointment.


When making an appointment with Deco55.com, the Customer must expressly report any access difficulties that the provider may encounter and measure the access passages from his home.

The Customer agrees to be present on the day of delivery agreed with Deco55.com or the carrier and to verify the conformity of his order upon receipt.


In case of absence of the Customer at the address indicated on the day of delivery, or in case of error made by the Customer in the indication of the delivery address, the costs of a new delivery will be at the charge of the Client.


Similarly, in the event of impossibility of delivery due to access difficulties not previously notified, the costs of a new delivery will be borne by the Customer.


In the event that this second appointment cannot be fixed by the Client, fifteen (15) days after a formal notice remained unsuccessful, the sale will be considered as resolved. Deco55.com will then keep any amount paid.


9.2 - The reflexes to adopt before confirming the order



Prior to any order and any purchase, the Customer must ensure that each product ordered can be delivered without difficulty and verify that the dimensions of the packages and products specified on the product sheet adapt to the constraints specific to their home (elevators , stairs, corridors, landing doors, destination room). The Customer must therefore take all necessary measures for the smooth running of the delivery.


Any difficulty encountered during the delivery of products for which the Customer is solely responsible has the effect of charging the Customer the costs of a new delivery of the products.



9.3 - Delivery times


Deco55.com undertakes to inform the Customer of the delivery times.


The delivery times indicated depend in particular on the availability of products.


The delivery times indicated are calculated in working days (except Sundays and public holidays).


 Delivery times run from the date of receipt by the Customer of an order confirmation email.

 In the event of a delivery problem, Deco55.com undertakes to make its best efforts to keep the Customer informed of the possible exceeding of the delivery date.


 9.4 - Good reflexes to adopt upon delivery


 Before signing the delivery note, the Customer must: • Check the apparent condition of the package (s). • Check the condition of the products inside the package (s)


Check the good conformity of the products in relation to the delivery note on the one hand and the goods ordered on the other hand.


It is therefore the responsibility of the Customer to carry out all the necessary verifications making it possible to judge the conformity of the products upon delivery.


This verification is deemed to have been carried out once the Customer has signed the delivery slip. In the event of anomalies noted during delivery, the Customer must make the necessary, detailed, legible and as precise reservations as possible (breakages, damage, non-compliance: product error, different color and / or dimensions; missing, etc. .) and refuse delivery of the package (s), stating the refusal on the order document .


When the delivery is made by carrier, the Customer must express his reservations on the delivery slip. The mention "subject to unpacking" will be refused.



 Article 10 - Reservation of ownership and transfer of risks


Deco55.com retains ownership of the products sold until full payment of its price (principal and accessories). Failure to pay one of the installments may result in the claim of the products by Deco55.com. These provisions do not preclude the transfer to the customer, from their reception, of the risks of loss and deterioration of the products purchased as well as of the damage that they could cause.



Article 11 - Product information


Deco55.com distributes with the utmost rigor the information concerning the essential characteristics of the products and undertakes to provide descriptions in the form of a "product sheet".


Differences between the products delivered and those represented on the Site may exist, in particular in the case of adaptations linked to technical or technological developments. These differences, since they do not relate to the essential characteristics of the products and do not affect their quality, cannot justify a cancellation of the order or a refusal of delivery. On the other hand, leather manufacturing having very different constraints from those of textile manufacturing (cut in skins and not in rolls of regular width), the leather cutting and sewing plans are different from those of the same models made of fabric.


 Due to the imponderables techniques inherent in shooting operations and Internet navigation software and / or visualization monitors, the rendering of colors on the Site is indicative and cannot in any case be guaranteed to be true to the reality of the colors of represented products. Article 12 - Right of withdrawal


12.1 - Terms of the right of withdrawal The Customer has, in accordance with the provisions of article L 121–21 of the Consumer Code, a withdrawal period of fourteen (14) clear days from the receipt or withdrawal of the products to return it to deco55. com for exchange or refund.


Return costs will be borne exclusively by the Customer.


However, the right of withdrawal cannot be exercised when the Customer has placed an order for custom-made items (all sofas, armchairs, chairs, beds or furniture) under the conditions described in article 4 above. In this context, no product returns will be accepted by deco55.com


12.2 - Product return procedure


 The Customer must assert his right of withdrawal:


  • either by duly completing the withdrawal form proposed in Appendix 1
  • or by contacting customer service by email at info@deco55.com The deco55.com after-sales service undertakes to contact the Customer within seventy-two (72) hours to detail the procedure for returning products.



The Customer must place all of the products in the package (s) and carefully prepare the return package (s).


 The Customer must return the products in their original packaging and in perfect condition. Returns will only be accepted if the procedure for returning products is respected by the Customer. The Customer may not exercise his right of withdrawal if the products returned are unsuitable for re-sale due, for example, to obvious deterioration.


In the event of a return of the products by the Customer who has exercised his right of withdrawal in accordance with this article, the Customer assumes the risks of transport.


In the case of non-compliant deliveries, the Customer must confirm his reservations concerning the products delivered no later than three (3) days following the date of receipt of the products. These reservations must be sent by registered letter with acknowledgment of receipt to deco55.com Customer Service, 30 rue de Rivoli, 75004 Paris and be accompanied by at least two photos as well as a copy of the carrier's  documents  showing reservations. After this period, all requests will be rejected by deco55.com and the responsibility of deco55.com cannot be engaged.


According to the legal guarantee of conformity, the complaints accepted will give rise to the conformity or the exchange of the defective or non-conforming product, or to its refund in the event of the unavailability of the product in stock or with suppliers. The returned product must be given to the carriers of deco55.com in perfect condition, in its original packaging and fitted with all its accessories.



Any product that has been damaged by the Customer will not be refunded. No spontaneous return, without agreement of deco55.com will be accepted.


Deco55.com carries out several warehouses in Europe, before planning a return the customer must have the agreement of deco55.com on the return warehouse chosen according to the articles In the absence of specific reservations made by the Customer, delivery will be presumed to be in conformity, subject to the guarantees described in article 13 below.


 12.3 - Exchange, refundof products  The Customer who has exercised his right of withdrawal has the choice either to request the exchange of products, or a refund. Product exchange Once the return accepted by deco55.com, the Customer's request is taken care of by deco55.com.  The new products will be delivered to the Customer within a reasonable time which is dependent on the availability of the products. In the absence of availability of the products ordered by the Customer, deco55.com will inform it and will reimburse the order under the conditions described below. Refund of products When the right of withdrawal is exercised, deco55.com undertakes to reimburse the Customer within fourteen days of the date on which this right has been exercised, after having carried out all the checks on the products.  

The method of refunding  will be made according to the means of payment chosen by the Customer. Any product that has been damaged by the Customer will not be refunded or partially refunded.


Article 13 - Guarantees



The Customer benefits from the legal guarantee of conformity as well as the guarantee against hidden defects in accordance with the legal provisions in force of articles L.211–1 to L.212–2 of the Consumer Code and articles 1641 to 1649 of the Code civil.


13.1 - In case of lack of conformity


Deco55.com is required to deliver products that comply with the contract and is responsible for any lack of conformity existing when the products are delivered. The action resulting from the lack of conformity is prescribed by two (2) years from the delivery of the products.


In accordance with the provisions in force in articles L.211-9 and following of the Consumer Code, the Customer chooses between repairing and replacing the products.


In case of impossibility or obviously disproportionate cost taking into account the value of the products, deco55.com is not bound to proceed according to the modality chosen by the Customer.


However, the Customer may not return the product and have the price returned or keep the product and be reimbursed part of the product only when the conditions provided for in article L.211–10 of the Consumer Code are met, c is to say if: •

13.2 - In case of hidden defect


Deco55.com is held under warranty for hidden defects in the thing sold which make it unsuitable for the use for which it is intended.


The action resulting from latent defects must be brought by the purchaser within two (2) years from the discovery of the defect.


In accordance with the provisions in force in articles 1641 and following of the Civil Code, the Customer has the choice to return the thing and to be restored the price, or to keep the thing and to be made part of the price.


Deco55.com may also offer the Customer the replacement of products.


13.3 - Exclusion of warranty



 The warranty cannot cover damage resulting from normal wear or from a cause arising from the intrinsic qualities of the goods.


The warranty cannot cover damage resulting from abnormal use or not in accordance with the seller's instructions, and in particular faults and their consequences linked to use not in accordance with the use for which the product is intended (professional use, collective,…).


Damage caused by the customer or a third party (e.g. transport, handling, assembly, etc.) is also excluded from the warranty. Deco55.com cannot be held responsible for damages resulting from the misuse of the products by the Customer or in the event of fortuitous event or force majeure.


13.4 - Complaint To exercise the legal warranty, the Customer must notify deco55.com of the defect as soon as it appears by filling out the form available on the Site and sending it, accompanied by at least two (2) photographs, to the Web Customer Service at following address: info@deco55.com The Customer must comply with the conditions for the return of products described in article 12.2 above.


The costs of returning the products are borne by deco55.com In the event that the Customer chooses to replace the products within the framework of these legal guarantees, the costs of sending the exchanged products are borne by deco55.com


Article 14 - Disputes and responsibilities



The Customer is required to check the completeness, the veracity of the information he provides to deco55.com when ordering and in particular the delivery address. The Customer is responsible for the information he has provided during registration and when ordering.


Deco55.com cannot be held responsible for any data entry errors which could cause delivery errors. If the delivery address turns out to be incorrect or if the Customer decides to change the delivery address after the products have been shipped by deco55.com, the costs of the new delivery will be borne by the Customer. The choice and purchase of products by the Customer are under his sole responsibility.


Consequently, the total or partial impossibility of using products in particular due to incompatibility of the product cannot give rise to any compensation, reimbursement or questioning of the responsibility of deco55.com, except in the case of a proven hidden defect, non-compliance, defect or the exercise of the right of withdrawal provided for by the provisions of the Consumer Code.


 Are considered fortuitous event or force majeure exempting from liability all irresistible, unpredictable facts or circumstances beyond the control of the parties, in particular in the event of a strike by carriers with a national impact, natural disasters such as floods or fires. The products sold on the Site are intended for private use.


In no case may they be used professionally by associations or communities, which do not meet professional standards.



Article 15 - Product not received


When the customer places an order with deco55.com, he agrees to receive the goods, he cannot change his mind before receiving the goods, and in case he is not available to receive the order and will not make an appointment to organize a new delivery, and the carrier is obliged to return the order to us, the shipping and return costs will be deducted from the refund .




Article 16 - IT law, files and freedoms

Article 17 - Intellectual property


The elements published on the deco55.com Site including in particular logos, registered marks, texts, photographs, images, drawings, models or tables constitute works protected by intellectual property rights or human rights .


Reproduction or representation, in whole or in part, of this Site is therefore prohibited without the express prior consent of the holders of these rights and would constitute an infringement punishable by the provisions of the Intellectual Property Code and / or a tort in nature to engage the civil responsibility of the infringers of the abovementioned rights.  The Customer will remain bound to perform its contractual obligations and may not, as such, claim any exemption from liability.


 The fact that one of the Parties has not required the application of any clause of these general conditions of sale, whether permanent or temporary, can in no case be considered as a waiver of the rights of this Part arising from said clause.




Article 21 - Language and applicable law



These general conditions of sale are written in French. In the event that they are translated into one or more languages, only the French text will prevail in the event of a dispute. These general conditions of sale are subject to French law.


The parties will seek, before any litigation, a possible amicable agreement. In the absence of an amicable agreement, any dispute relating to the formation, execution, interpretation and termination to which the general conditions of sale could give rise, even in the event of a warranty claim or multiple defendants, is of the exclusive jurisdiction of the French Courts. Article 22 - Miscellaneous


22.1 Evidence



 By express agreement between deco55.com and the Customer, e-mails will prevail between the Parties as well as the automatic registration systems used on the Site, in particular as to the nature and date of the order. The Customer can access, in accordance with the rules of common law, the electronic contract concluded with deco55.com.


To do this, they contact the Web Customer Service by email, to which they will provide all the information necessary to do so, including the order number and contact details.

In case of difficulty of interpretation between any of the titles of the articles and chapters and any of the clauses, the titles are deemed to be non-existent.
